What is existential damage?

The
existential damage is caused by the forced withdrawal to the performance of non-profitable, a source of pleasure or well-being for the victim, but not caused by impaired physical and mental integrity.
The category of existential damage has been developed relatively recently by the case and finds no explicit regulatory response.
The existential damage differs from other types of damage, namely: the financial loss, since it is not determined by an economic loss of any kind, and the moral damage because the action taken by the responsible person can not integrate the details of a crime and because it is a pain but in a deprivation of an actual, not a facere and finally by the biological damage as the existential damage can also exist apart from the existence of an injury to the person as impaired 'psychological and physical integrity of the injured party (Cass. 7.6.2000, n.7713; Cass. 3.2.1999, n. 911).
