If the law entrusts the regional fight against stray dogs to the veterinary services of the local health damages due to people attacked and bitten by stray dogs is caused by the ASL territorial jurisdiction.
The Supreme Court agreed with sentence # 8137 April 3, 2009 brought by a municipality that was being asked for compensation for damage suffered by a boy bitten by a stray dog.
The Supreme Court stated that 'for supervisory failure of stray dogs, it sued the company health locale, succeduta alla Usl, e non al Comune, sul quale, perciò, non può ritenersi ricadente il giudizio di imputazione dei danni dipendenti dal suddetto evento».
Tutto ciò si spiega dopo che il D.lgs. 502 del 1992 con la trasformazione delle Unità sanitarie locali in aziende sanitarie locali ha mutato la configurazione giuridica di queste ultime considerandole non più strutture operative dei comuni, ma aziende dipendenti dalla regione, strumentali per l’erogazione di servizi sanitari di competenza regionale.
