Judgement No. 2844 February 9, 2010
The employer who has paid the employee during the period of non-performance of work for temporary disability due to injuries caused by a third party is entitled to be indemnified by it for disbursements made (including those related to the contribution due to enti di assicurazione sociale) ed il diritto al risarcimento di tale danno, ove l’infortunio sia avvenuto a seguito di sinistro stradale, si prescrive in due anni, ai sensi dell'art. 2947, comma secondo, cod. civ.
